Child Support, Custody, and VisitationIf you are getting divorced and you have children, you and your soon-to-be ex-spouse will need to decide if one or both of you will have custody of your children. If one parent has primary custody, the other parent may see the children on a regular basis, known as visitation or parenting time. Custody and visitation are legal rights established in your parenting plan filed with the court.
And if you are the children's primary caretaker, you may be entitled to monthly payments from the other parent – in other words, child support.
